1. The Application
1.1. Aiwair (“the Application”) is owned and operated by Pebroc Inc., located in Montreal, Quebec, Canada (“we,” “us,” “our”).
1.2. The Application provides a platform to gather open-ended feedback and generate summary reports (“Services”). By using or accessing the Application, you agree to these Terms of Use (“Terms”).

2. Scope of License
2.1. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application for personal or internal business purposes in accordance with these Terms.
2.2. You must not reproduce, distribute, or create derivative works from any part of the Application, unless expressly permitted in writing.

3. Technical Requirements
3.1. You are responsible for ensuring that you have compatible hardware, software, and internet access.
3.2. We do not guarantee the Application will function on all devices or operating systems.

4. Maintenance and Support
4.1. We may provide updates, bug fixes, or other support at our discretion.
4.2. We reserve the right to modify or discontinue, temporarily or permanently, the Application or any features without prior notice.

5. Use of Data
5.1. You acknowledge and agree that all data on the platform (including but not limited to feedback content, user profiles, reports) belongs to Pebroc Inc. to the maximum extent permitted by law.
5.2. We will handle personal data in accordance with our Privacy Policy (see below).

6. User-Generated Contributions
6.1. You may submit feedback or other content (“Contributions”). You are solely responsible for the legality, reliability, and appropriateness of these Contributions.
6.2. You agree not to post or transmit any content that is unlawful, harassing, defamatory, hateful, or otherwise objectionable.

7. Contribution License
7.1. By submitting Contributions, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display such Contributions in aggregated or summarized form within the Application’s features.
7.2. Subject to our rights under this license, you retain any intellectual property rights you may have in your Contributions.

8. Liability
8.1. To the maximum extent permitted by law, Pebroc Inc. and its affiliates, officers, employees, or agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or relating to your use or inability to use the Application.
8.2. We do not guarantee the accuracy or reliability of any information or content in the Application.

9. Warranty
9.1. The Application is provided “AS IS” and without warranties of any kind, whether express or implied.
9.2. We disclaim any warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Product Claims
10.1. You acknowledge that we, not any app marketplace (if applicable), are responsible for addressing product claims related to the Application.

11. Legal Compliance
11.1. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government or Canadian Government embargo, and (ii) you are not listed on any government list of prohibited or restricted parties.

13. Termination
13.1. You may terminate your account at any time by sending an email to our support. However, your first and last name may still appear in aggregated or previously generated feedback reports.
13.2. We reserve the right to terminate or suspend your account or access to the Application at any time for violation of these Terms or other lawful reasons.

14. Third-Party Terms of Agreements and Beneficiary
14.1. The Application may contain links to third-party services or resources; we do not endorse and are not responsible for such third-party content.
14.2. These Terms do not create any third-party beneficiary rights unless expressly stated.

15. Intellectual Property Rights
15.1. All trademarks, service marks, logos, trade names, and other proprietary designations are the property of Pebroc Inc. or its licensors.
15.2. You agree not to remove, alter, or obscure any copyright or other proprietary notices within the Application.

16. Applicable Law
16.1. These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada.
16.2. Any disputes shall be brought in the courts located in Montreal, Quebec, Canada, and you consent to their jurisdiction.

17. Miscellaneous
17.1. If any provision of these Terms is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force.
17.2. Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
